2. Prohibited Activities and Behaviors
The following activities are strictly prohibited and may result in immediate termination of services:
- Fraudulent Activity: Misrepresentation of identity, property ownership, financial status, or any material facts
- Illegal Conduct: Engaging in any illegal activities related to property transactions, tax evasion, money laundering, or heritage property damage
- Intellectual Property Violation: Unauthorized use, reproduction, or distribution of ROC Real Estate proprietary content, reports, or methodologies
- Competitive Intelligence: Attempting to gather competitive intelligence or proprietary business information for unauthorized purposes
- System Interference: Attempting to access, modify, or interfere with our computer systems, databases, or security measures
3. Content Guidelines and Restrictions
- Accurate Property Information: All property descriptions, historical information, and documentation must be accurate and verifiable
- Copyright Compliance: All submitted images, documents, and materials must be properly owned or licensed for use
- Privacy Protection: Respect the privacy rights of all individuals involved in property transactions or professional relationships
- Professional Standards: Maintain content standards appropriate for professional heritage property services
- Regulatory Compliance: Ensure all content complies with advertising standards, financial promotion rules, and professional regulations
4. Age Restrictions and Requirements
Legal capacity and age-related requirements for using our services:
- Minimum Age: Users must be at least 18 years of age and have legal capacity to enter into binding contracts

6. Limitation of Liability
Our liability is limited as follows, to the maximum extent permitted by law:
- Maximum Liability Cap: Our total liability for any claim shall not exceed the total fees paid by the client for the specific service giving rise to the claim
- Professional Indemnity: Our professional indemnity insurance provides additional protection as required by RICS regulations
- Time Limitations: Claims must be brought within 6 years of the date when the cause of action arose, or within 3 years of when it was reasonably discoverable
- Mitigation Requirement: Clients must take reasonable steps to mitigate any losses or damages arising from our services
- Third-Party Claims: We accept no liability for actions or omissions of third parties, including contractors, specialists, or other professionals
7. Consequential Damages Exclusion
To the maximum extent permitted by law, we exclude liability for:
- Indirect Losses: Loss of profits, business opportunities, reputation, or goodwill
- Market Losses: Losses arising from property market fluctuations or economic conditions
- Development Losses: Losses arising from planning refusals, regulatory changes, or development restrictions
- Investment Losses: Losses arising from investment decisions based on our advice or recommendations
- Delay Damages: Losses arising from delays in service delivery or project completion
8. Force Majeure Provisions
We shall not be liable for any failure or delay in performance due to events beyond our reasonable control, including:
- Natural Disasters: Floods, earthquakes, severe weather, or other natural catastrophes
- Government Actions: Changes in law, regulation, government orders, or public health emergencies
- Infrastructure Failures: Power outages, telecommunications failures, or internet service disruptions

- Direct Discussion: Initial discussion with your primary ROC Real Estate contact to understand and address concerns
- Senior Management Review: Escalation to senior management for formal review and resolution proposals
- Professional Mediation: Use of professional mediation services through RICS or other recognized bodies
- Independent Arbitration: Binding arbitration through recognized professional arbitration services
- Legal Proceedings: Court proceedings as a final resort for unresolved disputes
11. Severability Clause
If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable:
- Partial Invalidity: The invalidity of any provision shall not affect the validity and enforceability of the remaining provisions
- Modification Rights: We reserve the right to modify invalid provisions to make them enforceable while preserving their intended purpose
- Continuation of Agreement: The remainder of these Terms and Conditions shall continue in full force and effect
- Judicial Interpretation: Courts may interpret provisions to give them maximum enforceable effect
- Replacement Provisions: Invalid provisions may be replaced with valid provisions that achieve similar commercial outcomes
